The court SHOULD impute the motherīs income based on her previous ability as a wage earner. It is her choice to not work - however her obligation to support your husbandīs and her son is not ended just because she doesnīt actually have any income coming in.
My husband was out of work for a few months years ago, but was still expected to pay child support for my stepson, which we did from my income.
If her husbandīs income is sufficient for their household, then wonderful. Thatīs great for her - however, you mentioned that your husband was given sole custody - but child support wasnīt discussed. Are you now going to court to establish this support order? If so, they will impute her income, with the ability to make at least minimum wage.
