Child Support When NCP is not working.

My husband was awarded sole custody of his son last November. It was a custody modification case and for some reason child support was not discussed. At the time my stepsonīs mother was pregant and not working due to a high risk pregnancy. She has since then had the baby in Feb., but still has not gone back to work. My stepson was three when my husband was given custody, but before then his mother had always worked and my husband had been paying support since the child was 5 months old. NCP recently told my husband that she has no intentions of going back to work anytime soon because her new husbandīs income is sufficient for their household and she doesnīt want to put her new baby in daycare. We go to court in July for child support and I was wondering if they will still base child support on her potential income since she is not working by choice and the fact that she is newly married rather than a physical disability.
