My response: You are wrong.

Your child support amount is based upon an inflated amount that in no way takes into consideration the father´s cost of maintaining his own home, nor does it take into account any costs incurred by the father when he has the child.

In other words, when your child support amount was determined, the amount takes into account your house payment, your bills, even your vehicle maintenance costs. The father has to pay all of these same bills, but the amount he pays for maintaining his home is not considered when determining his child support amount.

Neither are additional costs, like transportation, food, entertainment that the father incurs when the child is with him, so he is in actuality paying MORE for his part of the support of the child than is indicated in the court´s order.

Nevertheless, the amount that he pays in child support is about 60% of a TOTAL amount that the court decided was necessary for the care and support of your children. If you will look at your paperwork, you will find that the remaining amount is YOUR responsibility.

The 60% that the father pays is not intended to ENTIRELY support your children. It is partly YOUR responsibility. In other words, the money that YOU spend on your children, and the money that the father sends for your children are ALL EQUALLY INTENDED FOR YOUR CHILD by the law.

You have no right whatsoever to be "paid back" by the father for your part of what is necessary to support your children. You made them too, remember? And I expect that most courts would agree with my assessment of this situation.

Signed,

a stepmother who has assisted my husband in paying child support, carrying health insurance and caring for my stepson for nine years now.
