I would file for a modification of orders on the grounds that your ex is unable to care for your child while she is in prison. Your ex has good reason to think she could not regain custody if you´ve maintained a lifestyle that avoids the perpetual instability you describe in hers. I´m not a lawyer, but looking at the Minnesota Code on Family Law, you would have several grounds that your wife was unable to properly care for your daughter, while you, having a stable home and income, could.
