I believe the reason he got custody is because she "signed away" her parental rights - or she was told she could anyway.

The very fact that she WOULD sign away her parental rights is indicative, in my opinion, of the reason why a court would grant sole custody to the father, despite his legal problems - the parent who DIDNīT indicate that he would sign away his right to his children got custody.
